Tesla CEO Elon Musk recently fired his legal guns at OpenAI. Sam Altman, the co-founder of OpenAI, reached out to Musk via text messages after Musk filed a lawsuit against the AI research organisation. The lawsuit, filed in San Francisco Superior Court, alleges breach of contract. In an interview with Kara Swisher, Altman revealed that he exchanged texts with Musk. When Swisher asked if the text were on the lines of “WTF” when it came to the lawsuit, Altman revealed what the texts were. “It was like a little bit nicer than that,” Altman said. “I don’t remember. You know, the spirit of that.” He further said that the duo “sent some emojis back and forth.”

Musk, who was instrumental in funding OpenAI’s inception, claims that the organisation deviated from its original mission. When Musk bankrolled OpenAI, he secured an agreement with Altman and Greg Brockman (OpenAI’s president) to keep the company as a non-profit focused on developing technology for the public good. However, recent actions by OpenAI have led Musk to believe that the organisation has forsaken this noble purpose.

“OpenAI, Inc. has been transformed into a closed-source de facto subsidiary of the largest technology company in the world: Microsoft. Under its new board, it is not just developing but is actually refining an AGI to maximise profits for Microsoft, rather than for the benefit of humanity,” Musk, who is also the CEO of AI company xAI, said in the lawsuit.

In response to Musk’s lawsuit, OpenAI said that the case was “incoherent”. “There is no Founding Agreement, or any agreement at all with Musk, as the complaint itself makes clear. The Founding Agreement is instead a fiction Musk has conjured to lay unearned claim to the fruits of an enterprise he initially supported, then abandoned, then watched succeed without him. The documents Musk cites as purportedly memorialising a binding contract with him— OpenAI’s certificate of incorporation and a few emails—on their face show no promises to Musk,” OpenAI said.

Musk jokingly said that if OpenAI changed its name to ClosedAI then he would drop the lawsuit.
