Owner: Portage exotic dancers business hit with alcohol sales violation | News

PORTAGE, Pa. – A heavy police presence outside the exotic dancers venue Bodies in Motion Lounge blocked traffic on part of Main Street in Portage on Thursday night, witnesses said.

Club owner Gary Vaughn Jr. said the state police Bureau of Liquor Control enforcement served a search warrant on the business around 7 p.m. Thursday and confiscated about 40 cans of beer, one fifth of whiskey and some dollar bills, along with the security system recorder.

“They alleged I was selling beer without a license,” Vaughn said in a telephone interview from the business, adding that he was told a citation would be mailed to him.

A Pennsylvania State Police trooper at Ebensburg confirmed it was a liquor-control action. The bureau’s Altoona office and Harrisburg headquarters were closed for the Veterans Day holiday on Friday.

Councilman David Hayes said several unmarked police cars were blocking Main Street during the investigation while people waited outside the storefront. Other cars included a borough police cruiser, he said.

Vaughn said his business operates as a “bring your own bottle” – or BYOB – establishment and the alcohol was “donated,” along with some Jello shots that are kept in a cooler in the lounge’s main area.

“If you are over 21 you can bring in your own beer,” Vaughn said. “I always tell them if there is any donated beer in the cooler, it’s free to anyone over 21.”

Vaughn said the raid was politically motivated.

“This is nothing more than retaliation for me being here, because Portage police were here, too,” he said. “This is politically driven because the Borough of Portage is upset because their own ordinance could not be enforced.”

He said he reopened after police left and remained open until 1 a.m. Friday, noting the lounge was “packed.”

The business has been the center of controversy since last spring, when rumors circulated that a strip club was coming to the long-vacant storefront. Vaughn, who already operated Bodies in Motion traveling exotic dancers show, was renovating the building.

At the time, Portage Mayor Robert Fox told those protesting the potential business that the borough has an ordinance prohibiting nude-dance businesses, adding the council and the police department “will do anything in our power” to prevent a nude-dance business from operating.

In June, Vaughn said the facility would be the headquarters for the Bodies in Motion business and offer the venue for private events. He reversed that position in August after he said his lawyer told him the borough ordinance was too restrictive to be enforced.

The business opened Aug. 3 and has not received any citations under the borough ordinance, Vaughn said.

Hayes he is not aware of any borough involvement in Thursday’s police action.

“I have no knowledge of it, so I really can’t say who did what,” Hayes said. “But he knew something was going to happen eventually.”

Hayes added that he does not oppose the business, “if no laws are broken.”
